Terms and Conditions

MILL HILL SWIMMING SCHOOL TERMS & CONDITIONS

BOOKINGS & PAYMENTS:

1. 1.1 You have made a booking with Mill Hill School Of Swimming (“we” or “us“).
1.2 The booking confirmation, together with the Booking T&Cs, constitutes the entire agreement (the “Agreement“) between us and you. If any of the details in the booking confirmation appear to be incorrect, please contact us.
1.3 You hereby agree that you accept the terms of the booking confirmation together with the Booking T&Cs on behalf of yourself and any person you are booking on behalf of, and that all such persons shall always adhere to the specific terms of conduct within the venue. For the purposes of this Agreement, “you” shall include the person named on the booking confirmation and any person they are booking on behalf of.
1.4 All correspondence from us will be sent to the person named as the applicant on the booking confirmation. All regular communications from us will be sent in email format and it is your responsibility to inform us of any changes to your email address.

2. All lessons MUST be paid for in advance – Bookings are NOT confirmed until payment has been made.

3. The initial booking email you receive is only to acknowledge that we have received your PENDING booking request. Once we have received full payment, a second email with confirmation will be sent to you, at this point your booking is confirmed.

4. 4.1 A participant’s place is booked and committed for the whole term; cancellation during the term will receive no refunds and cannot be made up or transferred. The charges set out are for a specified time and day, there will be no refunds given for cancellation, or absence whatever the reason. Any additional lessons will be charged at the normal rate.
4.2. This includes missed sessions due to sickness, holidays, Religious Festivals and more.

5. If for any reason a lesson is cancelled by Mill Hill School of Swimming, we will endeavour to make this lesson up. This may be outside of the date range given at the start of term when booking. We will either reschedule the lesson(s) or credit your swimming pool account with information regarding this. No refunds will be given.

6. The agreed start date of any Class or Course which you have booked onto cannot be amended once payment has been received by us.

7. It is the parent/carers responsibility for the cost of getting to and from the pool.

8. In the event of a swimmer, parent, guardian, sibling or other associate: (i) refusing to obey an instruction from the Instructor or one of their staff members; (ii) behaving in an unruly manner towards the Instructor, one of their staff members or any other person; or (iii) causing damage to pool premises, or any of the furniture fixtures or equipment in those premises, the swimmer shall not be permitted to continue with the Classes. We shall then have the right to terminate the Agreement without further notice and without being required to offer any credit or refund to you and you shall not be accepted for any future course organised by the Instructor or the Agent.

9. We will always try and ensure your child’s group will have the same teacher for the term; however, this is not always possible due to holidays and sickness. We run a continuous training program where we work with assistant teachers who act as floaters during the sessions and support the main teacher.

10. Term dates are specific to each venue and can be found on the Mill Hill School of Swimming website. We have the right to change dates subject to us giving you prior notification.

11. Assigned Term dates may not always coincide with your school term dates and we are unable to replace lessons missed as a result.

12. A student’s progress as part of any Class or Course is not guaranteed.

13. If a class is at full capacity, we are unable to make any exceptions as this may impact our Health and Safety precautions.

14. Your chosen Booking Day & Time is only guaranteed for the term previously paid for. All future term bookings are first come first serve. To ensure your chosen slot, bookings must be made before the slot becomes full.

15. Mill Hill School of Swimming will not be held responsible for missed lessons due to traffic & parking.

16. Mill Hill School of Swimming is not liable for any vehicular damages that may occur within the premises car park.

CANCELLED LESSONS:

1. Classes may be cancelled at short notice where the pool is not considered suitable for use.

2. If for any reason a lesson is cancelled by Mill Hill School of Swimming, we will endeavour to make this lesson up. This may be outside of the date range given at the start of term when booking.
We will either reschedule the lesson(s) or credit your swimming pool account with information regarding this. No refunds will be given.

3. If we are unable to provide the Class for any reason, we will offer you a Class Credit valid for six (6) months from the cancellation date.

4. Class Credits from the COVID 19 pandemic closure will be valid for twelve (12) months from the cancellation date (22/11/2020).

5. We reserve the right to cancel or amend Classes or Courses in exceptional circumstances.

CHANING YOUR CLASS DAY OR TIME

1. We will attempt to accommodate any request you make with one (1) weeks’ notice upon calling us, subject to your requested space being available.

2. If the space, you request is not available we will make alternative suggestions. If we cannot accommodate your request, you will be unable to change your class day and time.

3. When transferring classes, Class prices may have changed. Where prices have increased, you will be required to purchase Classes at the new rate. Where prices have decreased, any difference in fees is non-refundable and will be retained as a Financial Credit for you to use against future bookings. Such Financial Credit shall be valid for a period of six (6) months from the date you transfer Classes, after which time the credit shall be forfeited.

SAFETY:

1. Any information given to Mill Hill School of Swimming, for example a child’s swimming ability or medical details will be assumed to be true and accurate, should this not be the case we will not be liable.

2. It is the parent/carers responsibility to notify us of any illnesses, injuries or medical conditions likely to impede a child’s safety or ability to participate.

3. We reserve the right to change times and locations for reasons beyond our control.

4. We will provide swimming aids and equipment; During group lessons a minimum of one member of staff will be qualified as a lifeguard.

5. It is the parent/ carers’ responsibility to maintain their children’s safety prior to and after their lesson and to maintain the safety of other children in their care. Please keep children that are not attending classes away from poolside.

6. We and the Instructor work together to ensure that recommended water temperatures are maintained, but in certain circumstances temperature may vary and cannot be guaranteed. Neither we nor the Instructor are liable for the pool or other facilities or any Losses or injuries suffered by you or any third party as a result of them.

7. Observers are NOT ALLOWED to use video or any type of camera/mobile phone in the changing rooms or poolside to comply with child protection and safeguarding.

8. We will not, except in respect of death caused by our negligence, be liable to you for any Loss incurred by you as a result of the instructor’s acts or omissions relating to the supply of any Classes, products, services or equipment or otherwise and whether or not done on our instruction or otherwise.

9. By agreeing to our T&C’s, you agree to always adhere to our Safeguarding policy, Changing Room Policy & Code of Conduct.

FORCE MAJEURE

The Agreement will be suspended during any period that we believe either we and/or you are prevented or hindered from complying with our respective obligations under any part of this Agreement by any cause which we designate as force majeure including strikes, disruption to the supply chain, political unrest, financial distress, terrorism, fuel shortages, war, civil disorder, and natural disasters. If such period of suspension exceeds one hundred and eighty (180) days, then we will, upon giving written notice to you, be able to require that the Agreement is terminated.

WEBSITE USAGE:

1. By using our website, you accept these terms and conditions in full; accordingly, if you disagree with these terms and conditions or any part of these terms and conditions, you must not use our website. You must be at least 18 years of age to book courses on our website; and by using our website or agreeing to these terms and conditions, you warrant and represent to us that you are at least 18 years of age.
